A Polk County judge has rejected a motion from David Flores' attorney to dismiss the murder charge against him. Flores goes on trial Monday for the 1996 murder of Phyllis Davis, who was caught in gang crossfire in shootout near 9th and University in Des Moines. The judge rejected a claim that prosecutors intentionally withheld information from the defense at Flores first trial.
