An appeals court's upheld a Polk County judge's order for a new trial for David Flores. He was convicted of 1st degree murder and terrorism for the 1996 murder of Phyllis Davis. In December 2009, a Polk County Judge granted Flores' request for post conviction relief and granted a new trial. KCCI reports that was based on claims of new and undiscovered evidence, that Rafael Robinson, who's dead, shot Davis. Flores was sentenced to life.
