Lawyers in the class-action suit against Des Moines franchise fee on natural gas and electric bills, say they'll file papers in the next few days for a judge to order $40-million in refund checks to residents who shouldn't have been paying the fee. The U.S. Supreme Court today declined to hear a city appeal to a lower court ruling finding the 5% fee too high to justify.
